Terms of Service

By accessing and using SchedulerX ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

These Terms of Service ("Terms") govern your use of our pharmacy scheduling application and related services operated by SchedulerX ("we," "us," or "our").

SchedulerX provides a cloud-based scheduling platform designed specifically for pharmacies, including:

• Staff availability management and shift scheduling
• Time-off request processing and approval workflows
• Shift swap coordination and management
• Email notifications and updates
• Analytics and reporting tools
• Multi-location support for pharmacy chains

Account Creation:

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the confidentiality of your account credentials
• You must notify us immediately of any unauthorized use of your account
• One person may not maintain multiple accounts

Eligibility:

• You must be at least 18 years old to use our services
• You must be authorized by your pharmacy to access scheduling systems
• You must comply with all applicable laws and regulations

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the Service for any unlawful purpose or to solicit unlawful conduct
• Impersonate another person or entity
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to gain unauthorized access to any portion of the Service
• Upload or transmit viruses, malware, or other malicious code
• Harvest or collect information about other users
• Use the Service to spam, harass, or abuse other users
• Violate any applicable laws or regulations

Free Plan:

• Limited features and usage as specified on our pricing page
• No payment required
• Subject to fair use policies

Paid Plans:

• Billed monthly or annually as selected
• Automatic renewal unless cancelled
• Price changes with 30 days notice
• Refunds subject to our refund policy

Payment Terms:

• Payment due upon subscription activation
• Late payments may result in service suspension
• You are responsible for all taxes and fees

Your Data: You retain ownership of all data you input into the Service. We do not claim ownership of your content or data.

Our Rights: You grant us a limited license to use your data solely to provide the Service to you.

Privacy: Our collection and use of your information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Data Export: You may export your data at any time through the Service interface.

Uptime:

• We strive for 99.9% uptime but do not guarantee uninterrupted service
• Scheduled maintenance will be announced in advance when possible
• We are not liable for downtime beyond our reasonable control

Support:

• Email support available to all users
• Priority support for paid plan subscribers
• Phone support available for Enterprise customers
• Response times vary by plan level

The Service and its original content, features, and functionality are and will remain the exclusive property of SchedulerX and its licensors. The Service is protected by copyright, trademark, and other laws.

You may not copy, modify, distribute, sell, or lease any part of our Service, nor may you reverse engineer or attempt to extract the source code of our software.

By You:

• You may terminate your account at any time through the Service interface
• Cancellation takes effect at the end of your current billing period
• You remain responsible for all charges incurred prior to termination

By Us:

• We may suspend or terminate your account for violation of these Terms
• We may terminate the Service with 30 days notice
• We may immediately terminate for illegal activities or security threats

Effect of Termination:

• Your right to use the Service ceases immediately
• We will provide data export options for a reasonable period
• We may delete your data after account termination

Service Disclaimer:

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability:

IN NO EVENT SHALL SCHEDULERX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR THE SERVICE DURING THE TWELVE MONTHS PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless SchedulerX and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service or violation of these Terms.

Healthcare Compliance: While our Service is designed for use in healthcare environments, you are responsible for ensuring compliance with all applicable healthcare regulations in your jurisdiction.

Professional Licensing: You are responsible for maintaining all required professional licenses and certifications for your role.

Workplace Policies: Use of our Service must comply with your employer's policies and procedures.

These Terms shall be governed by and construed in accordance with the laws of Canada, without regard to its conflict of law provisions.

Any disputes arising under these Terms shall be resolved through binding arbitration in accordance with the rules of the Canadian Arbitration Association.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last updated" date.

Your continued use of the Service after changes become effective constitutes acceptance of the new Terms.

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
